Are civil matters a little trickier?
The lawyer in a civil suit is only really interested in the evidence that helps their side.
Nevertheless, computer examiner is obligated to report on all findings, favorable or unfavorable. A good attorney will want to know all of this anyway -- it gives a clue what the other side's forensics expert might discover.
If an examiner's findings are unfavorable, he/she might not be asked to testify.
It is the examiner's role to be neutral.
